3. Return and Refund Policy:
3.1 Return and Refund Policy for Parcel Safe Systems LLC. last updated August 1st, 2024.
3.2 Introduction: This Return and Refund Policy outlines the terms and conditions for returns and refunds of Parcel Safe Systems, LLC. products. We understand that our products may be purchased well in advance of installation and use, and we’ve designed our policy with this in mind.
3.3 Eligibility for Returns: Products eligible for return include but are not limited to:
a) Unopened Products – Are eligible for return within 60 days of purchase date, must be in original packaging, unused, and in new and resalable condition. Refunds will equal 100% of the purchase price of the product including sales tax and applicable shipping costs, less a restocking fee of $100.00 or 10% of the purchase price, whichever is less at the time of sale; b) Opened but Uninstalled Products – Are eligible for return within 30 days of purchase date. Product(s)must be in original packaging with all components intact in new and resalable condition. Refunds will equal 100 % of the purchase price of the product, including sales tax and applicable shipping costs, less a restocking fee of $200.00 or 10% of the purchase price, whichever is less at the time of sale.
c) Installed and partially installed but Unused Products: Are not eligible for return.
3.4 Other Non-Returnable Items: a) Custom or specially ordered products; b) Products having been used; c) Products damaged due to improper storage, care, installation, or use.
3.5 Return Process: a) Contact our Customer Service to initiate a return and obtain a Return Merchandise Authorization (RMA) number; b) Provide proof of purchase, installation date (if applicable), and reason for return; c) Package the product securely in its original packaging or equivalent; d) Product(s) shipped to the address provided, with the RMA number clearly marked on the outside of the package.
3.6 Refunds will be: a) Issued using, where applicable, the original payment method within 10-15 business days after we receive and inspect the returned product; b) Original shipping charges are non-refundable; c) Return shipping costs are the responsibility of the customer, except in cases of defective products.
3.7 Restocking Fees: See 3.3 a) above.
3.7 Defective Products a) If a product is found to be defective within 30 days of installation, we will replace it at no cost or provide a full refund, including shipping charges. b) For products found defective after 30 days of installation, please refer to our Warranty Policy.
3.8 Damaged in Transit: If your product arrives damaged, refuse delivery if possible and contact us immediately. If you’ve already accepted delivery, contact us within 48 hours with photos of the damage.
3.9 Return Period for Contractors and Homebuilders: We offer an extended return period for verified contractors and homebuilders. Please contact Parcel Safe Systems at 539.999.7233 (SAFE) for more information.
3.10 Cancelled orders: Orders can be cancelled for a full refund before the product has shipped. Once shipped, our standard return policy applies.
3.11 Exceptions to the Return and Refund Policies: We reserve the right to make exceptions to this policy at our discretion. Any exceptions will be made on a case-by-case basis and do not constitute a waiver of this policy.

4. Shipping Policy:

4.2 Shipping Area: We currently ship our products only within the continental United States. We do not currently ship to Alaska, Hawaii, U.S. territories, or international destinations
4.3 Shipping Methods: Due to the size and weight of our product, we use the following shipping methods, according to applicable carriers: a) Ground Shipping: 5-7 business days b) Expedited Shipping: 3-5 business days (where available)
4.4 Shipping Costs: Shipping costs are calculated based on the destination zip code and chosen shipping method. The exact cost will be displayed at checkout before you complete your purchase. There is no mark-up on shipping.
4.5 Order Processing Time: Please allow1 to 3 business days for order processing before shipment, unless otherwise specified by Parcel Safe Systems.
4.6 Tracking: Once your order ships, you will receive a confirmation email. Depending on the shipper, you may also receive an email with a tracking number to track your package on the carrier’s website.
4.7 Delivery: Due to the size and weight of the product: a) Curbside delivery is standard. The carrier will not bring the item inside your home; b) Someone must be present to receive and sign for the delivery; c) Please ensure there is adequate space for delivery at the provided address.
4.8 Special Handling: Given the product’s weight, we recommend having assistance available when moving or installing the product after delivery.
4.9 Damaged or Lost Shipments: We take great care in packaging our products; however, if your item arrives damaged: a) Thoroughly inspect the package upon arrival before signing; b) If damage is visible, refuse the delivery and contact us immediately; c) If you discover damage after accepting delivery, contact us within 48 hours with photos of the damage; If your Parcel Safe Systems delivery is lost in transit: a) contact Parel Safe Systems immediately at 539.999.7233 (SAFE), and the carrier.

Cancellations will take effect at the end of the most current billing cycle; b) Annual subscriptions: Cancel within 14 days of purchase for a full refund. After 14 days, refunds will be prorated for the unused portion minus and administrative fee of 10% of the annual subscription fee.

12.2 Limited Warranty Coverage: Parcel Safe Systems, LLC (“we,” “us,” or “our”) warrants that our Package Safes (“Product”) will be free from defects in materials and workmanship under normal use and service for a period of one (1) year from the date Warranty Start Date (“Warranty Period”).
12.3 Warranty Start Date: The Warranty Period begins on the date of original purchase, regardless of installation date or first use. Our warranty covers Products that may be stored on-site or installed for weeks before use, provided they have been properly stored and installed according to our guidelines.
12.4 What This Warranty Covers During the Warranty Period: We will repair or replace, at our discretion and determination, any defective Product or part thereof, at no charge to the original purchaser, including: a) Defects in materials; b) Defects in workmanship; c) Mechanical failures caused by improper manufacturing or assembly.
12.5 This Warranty Does Not Cover: a) Normal wear and tear; b) Improper installation or use; c) Misuse, abuse, or neglect; d) Damage caused by accidents or dropping the product; e) Acts of nature, extreme temperatures and weather conditions; e) Unauthorized modifications or repairs; f) Cosmetic damage while opening product packaging; g) Losses due to theft; g) Improper: storage, connection to other power sources, dropping or misuse of the Product or components; h) Damages caused by 3rd party installers or contract labor working on any part or aspect of the Product.
12.6 How to Obtain Warranty Service: To obtain warranty service, contact our customer service department at support@parcelsafesystems.com. You may be required to provide: a) Proof of purchase; b) Product serial number; c) Description of the defect; d) Photos or videos of the issue; e) Reasonable validation of subscription use, if applicable.
12.7 Warranty Service Process: Upon receiving a valid warranty claim, we will: a) Provide instructions for returning the Product (if necessary); b) Repair or replace the defective Product or part; c) Cover shipping costs for the return of the repaired or replaced Product.
12.8 Warranty Limitations: a) This warranty is non-transferable and extends only to the original purchaser; b) Our liability is limited to the repair or replacement of the defective Product; c) We are not responsible for any incidental or consequential damages.

14. Dispute Resolution Policy:
14.1 Dispute Resolution Policy for Parcel Safe Systems LLC. was last updated August 1st, 2024.
14.2 By providing this Dispute Resolution Policy, Parcel Safe Systems, LLC aims to address disputes fairly, efficiently, and in good faith, while maintaining positive relationships with our valued customers.
14.3 At Parcel Safe Systems, LLC (“we,” “us,” or “our”), we are committed to providing high-quality products and services. We recognize that disputes may occasionally arise, and we have implemented this Dispute Resolution Policy to address such situations fairly and efficiently.
14.4 Scope of Dispute Resolution Policy: This policy applies to all disputes between Parcel Safe Systems, LLC and its customers relating to only our products, mobile application and any related services.
14.5 Initial Contact: If a customer has a concern or dispute, we encourage you to first contact our Customer Service department at 539.999.7233 (SAFE), email at support@parcelsafesystems.com or online at www.parcelsafesystems.com. Our representatives will make every effort to resolve your issue promptly and satisfactorily.
14.6 Formal Complaint Process: If your concern is not resolved through our Customer Service department, you may initiate our formal complaint process: a) Submit a written complaint to: Parcel Safe Systems, LLC Attn: Dispute Resolution at legal@parcelsafesystems.com. The complaint should include: a) Your contact information; b) A detailed description of the issue; c) Any relevant documentation; d) Your proposed resolution.
14.7 Complaint Acknowledgement: We will acknowledge receipt of your complaint within 5 business days. A designated representative will investigate your complaint and respond within 15 days with our proposed resolution.
14.8 Mediation: If the dispute remains unresolved after our formal complaint process, the parties may by agreement submit to mediation. The mediation will be conducted by a neutral third-party mediator agreed upon by both parties. The cost of mediation will be shared equally between Parcel Safe Systems, LLC and the customer, unless otherwise agreed. Mediation sessions will be confidential. Any agreement reached through mediation will be binding on both parties. If mediation is unsuccessful, the parties may, by agreement, submit the dispute to binding arbitration.
14.9 Arbitration: The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Tulsa, Oklahoma. The arbitrator’s decision will be final and binding on both parties. Each party will bear its own costs of arbitration, including attorney’s fees, unless the arbitrator decides otherwise.
14.10 Small Claims Court Option: For disputes involving amounts within the jurisdiction of small claims court, the parties may agree to resolve the dispute in small claims court rather than through arbitration.
14.11 Class Action Waiver: By agreeing to this Dispute Resolution Policy, you waive any right to participate in a class action lawsuit or class-wide arbitration.
14.12 Limitations: All disputes against the company are limited to the total dollar amount of the original purchase of the Product in dispute.
14.13 This Dispute Resolution Policy does not prevent either party from seeking injunctive or other equitable relief in court to prevent the actual or threatened infringement or misappropriation of intellectual property rights.
14.14 Changes to this Policy: We reserve the right to modify this Dispute Resolution Policy at any time. Any changes will be effective immediately upon posting the updated policy on our website. Your continued use of our products or services after such changes constitutes your acceptance of the new policy.

15. Subscription Terms:
15.1 These Subscription Terms (“Terms”) govern your use of the mobile application subscription services provided by Parcel Safe Systems, LLC (“we,” “us,” or “our”) to support our Parcel Safe products.
15.2 Acceptance of Terms: By subscribing to our mobile application services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our subscription services.
15.3 Description of Services: Our subscription services provide enhanced functionality for compatible Parcel Safe products through our mobile application. Features may include, but are not limited to: a) Real-time notifications; b) Remote access control; c) Video monitoring (where applicable); d) 2-way voice communications; e) Product feature adjustments; f) Product and feature accessibility; g) Usage history and analytics; h) remote software/firmware updating.
15.4 Subscription Plans and Pricing are clearly displayed on our website. We reserve the right to change our subscription plans and pricing at any time. Any changes will be communicated to users in advance.
15.5 Payment and Billing: Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select (see section 10. Payment Terms above); a) Payment will be charged to your chosen payment method at the time of purchase or shortly thereafter; b) Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
15.6 Payment Authorization: By accepting these terms, you authorize us to charge your payment method for the subscription fees associated with your chosen plan and credit card information that you provided.
15.7 Free Trials: We may offer free or promotional trials of our subscription services. At the end of the free trial period, your subscription will automatically convert to a paid monthly subscription unless cancelled before the trial ends.
15.8 Cancellation and Refunds: You may cancel your subscription at any time through your account settings or by contacting our customer support. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial subscription periods.
